Privatlivspolitik for jobansøgere i Falck A/S og hermed koncernforbundne danske selskaber

I forbindelse med rekruttering indsamler og behandler det Falck selskab, hvori du ansøger om ansættelse (herefter ”Falck”), dine personoplysninger som angivet i denne privatlivspolitik. Falck er dataansvarlig i forhold til de oplysninger, som du indtaster eller uploader i din jobansøgning via rekrutteringssystemet Cornerstone. I denne privatlivspolitik beskriver vi vores behandling, brug og videregivelse af dine personoplysninger i forbindelse med rekrutteringsprocessen.

Typer af personoplysninger vi indsamler og behandler

Når du ansøger igennem rekrutteringssystemet, registrerer og behandler vi de af dine personlige oplysninger, som du indtaster eller uploader i forbindelse med din ansøgning, f.eks. dit navn, kontaktoplysninger, CV, ansøgning, uddannelsespapirer, referencer, billede, videopræsentation, m.v.

På dette stadie i rekrutteringsforløbet har vi ikke behov for dit cpr-nummer, hvorfor vi henstiller til, at cpr-nummer undlades på dokumenter før uploading. Vi henstiller også til, at du undlader at uploade følsomme oplysninger, som f.eks. politisk overbevisning, fagforeningsmæssigt tilhørsforhold m.v. Hvis du alligevel deler ovennævnte oplysninger med os, vil oplysningerne blive behandlet på samme måde som resten af dine indtastede/uploadede oplysninger.

Formål og retsgrundlag for vores behandling

Vi behandler dine oplysninger med det formål at vurdere dig i forhold til en konkret stilling hos Falck.

Retsgrundlaget for vores registrering og behandling af dine personoplysninger er vores legitime interesse i at gennemføre en rekrutteringsproces, jf. databeskyttelsesforordningens artikel 6, stk. 1, litra f.

I den udstrækning, at du på eget initiativ overlader oplysninger til os, som vi ikke har bedt om, er behandlingsgrundlaget dit samtykke, jf. databeskyttelseslovens § 12, stk. 3, og oplysningerne vil i så fald blive behandlet på samme måde, som resten af dine indtastede/uploadede oplysninger.

Kræver den stilling, du søger, at du gennemfører personlighedstests eller lignende, vil du modtage besked herom i forbindelse med at vi behandler din ansøgning. I så fald vil resultatet af disse tests indgå i bedømmelsen af din ansøgning. Retsgrundlaget for denne behandling er vores legitime interesse, jf. databeskyttelsesforordningens artikel 6, stk. 1, litra f.

Såfremt vi i slutningen af rekrutteringsprocessen måtte anmode dig om at fremvise en straffeattest, børneattest og/eller hvis en sikkerhedsgodkendelse skal indhentes, vil retsgrundlaget for vores behandling være dit udtrykkelige samtykke, jf. databeskyttelseslovens § 8, stk. 3 og databeskyttelsesforordningens artikel 6, stk. 1, litra a.

Som en del af rekrutteringsprocessen kan det forekomme, at vi indhenter referencer fra din(e) tidligere arbejdsgiver(e). Vi indhenter dog kun referencer, såfremt du har givet dit samtykke hertil, jf. databeskyttelsesloven § 12, stk. 3 og databeskyttelsesforordningens artikel 6, stk. 1, litra a. I så fald vil vi kontakte dig enten telefonisk eller pr. e-mail og bede om dit forudgående samtykke.

I det tilfælde, at vi indsamler oplysninger om dig, som er offentligt tilgængelige, f.eks. via LinkedIn, vil retsgrundlaget for vores behandling være vores legitime interesse i at vurdere dig i forhold til den konkrete stilling, jf. databeskyttelsesforordningens artikel 6, stk. 1, litra f. Vi indsamler alene de oplysninger, som er nødvendige og relevante for os for at kunne foretage denne vurdering.

Deling af personoplysninger med tredjeparter

Uanset hvilket selskab, du har søgt en stilling i, vil det være Falck Danmark A/S, som behandler dine oplysninger. Det gør vi, fordi vores rekrutteringssystem ejes og administreres af Falck Danmark A/S. Derudover kan vi dele din ansøgning og andre oplysninger, som vi har modtaget fra dig, med de af vores medarbejdere, som er involveret i rekrutteringen, og med de tredjeparter, som bistår os med processen. Dette kan inkludere systemleverandører, rekrutteringsfirmaer, eksterne udbydere af personlighedstests m.v. Falck har indgået databehandleraftaler med alle relevante tredjeparter, som agerer databehandlere på vegne af Falck, i overensstemmelse med kravene fastsat i GDPR.

Overførsel af personoplysninger til modtagere i lande uden for EU/EØS

I det tilfælde, hvor data overføres til et tredjeland, dvs. lande uden for EU/EEA, sikrer vi et tilstrækkeligt beskyttelsesniveau for en sådan overførsel, f.eks. ved indgåelse af EU’s ”Standard Contractual Clauses”. Sletning og opbevaringsperioder

Vi opbevarer din ansøgning samt de øvrige oplysninger, som du indtaster eller uploader, indtil rekrutteringsprocessen er afsluttet og i den periode efterfølgende, hvor oplysningerne er relevante og nødvendige, f.eks. til brug for dokumentation af rekrutteringsprocessen. Oplysningerne opbevares dog aldrig længere end 6 måneder, medmindre du selv aktivt forlænger opbevaringsperioden ved at give dit samtykke til at vi fortsat må opbevare dine oplysninger i tilfælde af fremtidige relevante stillinger, eller medmindre du opnår ansættelse i Falck. Opnår du ansættelse i Falck, opbevarer vi din ansøgning og eventuelle øvrige personoplysninger indsamlet i forbindelse med rekrutteringsprocessen som en del af din personalemappe.

Dine rettigheder

Du har ret til at få indsigt i de personoplysninger, som vi behandler om dig. Derudover har du ret til at gøre indsigelse mod vores behandling af dine personoplysninger samt ret til at bede om, at behandlingen af dine personoplysninger begrænses, at dine personoplysninger berigtiges, eller – i visse tilfælde – at dine personoplysninger slettes. Derudover har du – under særlige omstændigheder – ret til at anmode om at få udleveret dine personoplysninger i et struktureret, almindeligt anvendt og maskinlæsbart format (dataportabilitet).

Du har ret til at indgive en klage over vores behandling af dine personoplysninger til Datatilsynet. Ønsker du at klage til Datatilsynet, er Datatilsynets kontaktoplysninger: Datatilsynet, Carl Jacobsens Vej 35, 2500 Valby, (dt@datatilsynet.dk).

Ved at logge ind på din kandidatprofil i Cornerstone og benytte funktionen ”rediger profil”, kan du desuden altid selv redigere, tilføje eller slette i dine oplysninger.

I de tilfælde, hvor vores behandling er baseret på dit samtykke, har du til enhver tid ret til at tilbagekalde dette. Det vil betyde, at de pågældende oplysninger ikke længere vil kunne behandles af Falck, medmindre der er et andet lovligt behandlingsgrundlag. Privacy Notice for job applicants in Falck A/S and associated Danish Entities

In connection with the recruitment process, the Falck company in which you apply for a job (hereafter “Falck”) collects and processes your personal data as stated in this Privacy Notice. Falck is responsible, as a data controller, for your personal data that you register and upload in your job application via the recruitment system Cornerstone. In this Privacy Notice we describe our processing, use, and transfer of your personal data throughout the recruitment process.

Personal data that we register and collect

We register and process your personal data when you apply for a job in the recruitment system, e.g. your name, contact details, CV, job application, diplomas, references, your photo, and video presentation, etc.

At this point, it is not relevant to process your cpr-number and therefore, we kindly ask you to refrain from sharing such data with us. Furthermore, we kindly ask you to refrain from uploading any special categories of data, e.g. your political opinion, trade union membership, etc. However, in case you upload the said data, we will process these data like any other data provided by you.

Purposes and legal basis for our processing

We process your personal data with the purpose to assess you for the job position in question.

The legal basis for our registration and processing of your personal data in connection with the recruitment process is our legitimate interest, cf. article 6(1)(f) of the GDPR.

In case you upload data, which we have not asked for, the legal basis for such processing is your consent, cf. Sec. 12(3) in the Danish Data Protection Act, and we will process these data like any other data provided by you.

We may contact you in connection with our processing of your job application, if the position you apply for requires that you perform a personality test or the like. The result of the test will be part of our assessment of your job application. The legal basis for our processing is our legitimate interest, cf. article 6(1)(f) of the GDPR.

If relevant for the position in question, we may by the end of the recruitment process ask you to provide a criminal record, child record, and/or a security clearance. If that is the case, the legal basis for our processing will be your explicit consent, cf. Sec. 8(3) of the Danish Data Protection Act and article 6(1)(a) of the GDPR.

As part of the recruitment process, we may take up reference(s) from your former employer(s). If that is the case, we will obtain your consent prior to contacting your reference(s), cf. Sec. 12(3) of the Danish Data Protection Act and article 6(1)(a) of the GDPR. If that is the case, we will contact you by phone or email.

In case we collect data from publicly available sources, e.g. LinkedIn, the legal basis for our processing is our legitimate interest, cf. article 6(1)(f) of the GDPR. We will only collect data that is necessary and relevant to us in order to assess you for the position in question.

Sharing of personal data with third parties

Regardless of the entity in which you apply for a job in, Falck Danmark A/S will process your personal information. We do this because our recruitment system is owned and administrated by Falck Danmark A/S. Further, we may share your job application and other information provided by you with the employees within Falck that are involved in the recruitment process and with the third parties that assist us during the process, e.g. recruitment companies, external providers of the personality tests, etc. Falck has entered into data processing agreements with the third parties acting as data processors on behalf of Falck in compliance with the provisions under the GDPR.

Transfer of personal data to recipients in countries outside EU/EEA

In case we transfer your data to third countries, i.e. recipients in countries outside of EU/EEA, we will ensure an adequate level of protection, e.g. by entering into EU’s Standard Contractual Clauses for transfers from data controllers to data processors in countries without an adequate level of protection outside EU/EEA. Erasure and retention periods

We store your job application and other information provided to us via the recruitment system throughout the recruitment process and for a period afterwards, during which the data is relevant and necessary, e.g. to document the recruitment process. However, this period will not exceed 6 months, unless you actively extend this period by your consent with the purpose to store your information for any future relevant positions, or unless you obtain employment in Falck. If you obtain employment in Falck, we will store your job application and, if appropriate, other information collected during the recruitment process in your private personnel folder.

Your rights

You have the right to request access to the personal data that we process about you. Further, you have the right to object to our processing of your personal data as well as the right to request restriction or rectification of your personal data, or – in certain cases – the right to request erasure of your personal data. In addition, you have the right – with certain limitations – to receive your personal data in a structured, commonly used and machine-readable format (data portability).

You have the right to file a complaint with the Danish Data Protection Authority (DA: Datatilsynet), if you disagree with our processing of your personal data. You can edit, add and delete in your personal data by login into your candidate account in Cornerstone using the function “edit account”.

If the processing is based on your consent, you have a right to withdraw your consent at any time. This means that the information can no longer be processed by Falck, unless the processing can be based on another legal basis. The withdrawal of your consent will not affect the processing already incurred prior to withdrawal of the consent.
